Please read this thoroughly and carefully, you are responsible for your knowledge of my tos.if you are uncomfortable or disagree with rules stated in my tos, then you will be declined a service. Breaking my tos intentionally will result in a grey/blacklist depending on severityBY purchasing my art or designs (even if secondhand) means you automatically adhere to my TOS. you as the buyer/owner hold all responsibility in being updated and knowing of said tos.updates to tos may happen without any prior notice. though, if you're in my discord server it is more likely you will be informed.if you are unsure of anything, just ask! i wont bite if you're curious about something that wasn't directly stated here or just have general questions!

GENERAL RULES

Ⅰ. ✧ ⭒ ───────── ───────── ⭒ ✧

⤷ ✧ my art cannot be used for nfts or ai algorithms under any circumstances.

⤷ ✧ I reserve the right to decline any and all commissions. with or without an explanation.

⤷ ✧ I reserve the right to use any and all work I create as example pieces or promotions.

⤷ ✧ Do not edit my art under any circumstances unless i give explicit permission.

⤷ ✧ you as a purchaser of my art/designs may show this on external site if i am clearly and properly credited in those spaces. do not use my art if you are not in direct ownership of the character or piece otherwise.

⤷ ✧ My turn around time varies. It can go from a few days to a few months. I have a life behind all the art, so please understand. I will try to notify if there will be delays. you are welcome to poke me if it has been 2+ weeks after payment! (NOTE: Constant harrassment/poking will result in a cancel. please be mindful before asking!)

⤷ ✧ rushing a commission is not an option. we can discuss deadlines/rush fees, but it is likely i will not go through with it. I am not very consistent at art and struggle to maintain motivation to consistently continue pieces, so please understand this before requesting such a thing.

⤷ ✧ Do not heavily reference my designs and work. inspiration is okay, but carbon copies/rip-offs will result in a grey/blacklist.

⤷ ✧ do not force your tos on my art or designs. even if it is a redesigned version, it is still my creation. this also goes the other way around. do not force my tos on designs i have redesigned or updated, nor my label.

⤷ ✧ i will not copy others characters, designs, style, and etc no matter what. i do not mind inspiration such as you sending a piece that you would like mine to have a similar feeling as, but otherwise this will be a no. if you persist on this, i will grey/blacklist you depending on severity.

Ⅱ. ✧ ⭒ ───────── ───────── ⭒ ✧

⤷ ✧ if you purchase a full piece (lined and flatcolor) there will be 3 stages of wips. Sketch, Lines, and color. once approved i will move onto the next stage. if you do not respond within a week of me posting an approval check I will move on with the piece. if you do not request the full process, it will follow a similar formula (fuch as a sketch and then color stage).

⤷ ✧ minor changes such as limb positioning during sketch are free up to 3 times before I start charging $5 per change. I will redraw an entire pose once before charging for more major changes (if requested, If i redraw it out of my own will you will not be charged).

⤷ ✧ if i have passed onto the lining/coloring stage, you may not request any new major changes. if you are insistent on a change, this will result in additional fees.

⤷ ✧ i will decline or ask for a different character if they're too complex, portray things i do not support, or are pending redesigns or not completely up to date upon commissioning. (pending rede does not apply if you're requesting one)

⤷ ✧ I keep all files with a merged and unmerged version! if you notice a mistake at completion, please inform me! I will only change small edits. if i have to draw something new (such as a collar) you will be denied. if it has been longer than 3 days i may not want to edit it, but you may ask regardless.

Ⅲ. ✧ ⭒ ───────── ───────── ⭒ ✧

⤷ ✧ Do not use my art commercially. I'd rather not deal with all the things that come with that sort of thing. If curious, we can discuss more.

⤷ ✧ I work with paypal only at this time (NOTE: if there are currency conversions, they must equal my value in usd. i will ask for full payment or issue a refund if it is not correct) I do not take cashapp, venmo, or other apps at this moment.

⤷ ✧ Payment must be sent before the commission is started. unless requested differently, this will be the default. If you're a newer commissioner and prefer half first half later, you may ask for the option. I will ask for half at the sketch stage, then half before completion. I will only do this 2 times before asking for upfront payments in later commissions. you must ask for this option or I will do full payment before sketch.

⤷ ✧ Refunds are currently not available unless its a dire situation. I currently do not have a stable enough income to support random refunds.

⤷ ✧ I will likely be open to payment plans if it was discussed and mentioned prior to purchase. requesting this after payments have been sent will not be allowed.

⤷ ✧ do not send payment unless i have intiated it. if i send you my paypal link or general information, then i have confirmed the commission.

DESIGN OWNERSHIP

Ⅰ. ✧ ⭒ ───────── ───────── ⭒ ✧

⤷ ✧ Do not sell a design of mine until 1 week has passed. This goes for any species. You may ask me before the 1 week and it is likely i will let you sell early!

⤷ ✧ Do not sell for more than you paid for if directly purchasing from me. If additional art was commissioned/created, then you can ignore this rule. (secondhand purchase where val was unsure does not apply. though, purposeful increase with knowledge of price will result in grey/blacklist.)

⤷ ✧ do not use my designs for any racist/xenophobic, lgbtqphobic, disturbing fetish art, and/or pieces/stories that encourage any harmful behaviors. if your use of my designs/art goes against this, i have full right to blacklist you if necssary.

Ⅱ. ✧ ⭒ ───────── ───────── ⭒ ✧

⤷ ✧ If changing species, please ask me beforehand. If approved, my credit must be on the ref of the character. "Original design by: Archir_ion." works just fine for me! other forms such as a furry/humanoid/etc may be discussed, but credit must be maintained in any form changes. do not push your tos/creation credit of a design if change in form is done.

⤷ ✧ do not overhaul or void designs. minor or slightly drastic redesigns are okay, but the character MUST be recognizable. if you do not like the design anymore, please just sell them to another person who will enjoy them.

Ⅲ. ✧ ⭒ ───────── ───────── ⭒ ✧

⤷ ✧ If selling/trading, check my blacklist. If you are caught trading/selling/etc my designs to blacklisted users, you may get added yourself.

⤷ ✧ PLEASE POST TO TOYHOU.SE WITHIN THE DAY OF RECEIVING. Makes it easier for me to find my designs and track. (Credit Archir_ion on th!)

⤷ ✧ all of my designs must be posted to th. if you do not own a th, I can make you one. deleting or not posting these designs will result in a grey/blacklisted. i want to keep track of my designs, so please do not just make a th then sell them off platform. this will also result in a grey/blacklist.

⤷ ✧ to elaborate, original toyhouse's of designs must never be deleted. regardless if you do not want the oc anymore and no one will take them, do not delete it because you do not use th. if it becomes such a drastic situation as that, please inform me and i will take the design. deleting of th will result in a blacklist unless explicit permission is given by me.

⤷ ✧ break of tos or being added to my blacklist will never result in me taking my designs from you. if you have validly purchased or obtained a design before any issues, it is your character regardless.

⤷ ✧ if you no longer want a design/character created by me, please tell me! i may want them back. but do not force these characters on me.

Ⅳ. ✧ ⭒ ───────── ───────── ⭒ ✧

⤷ ✧ I allow my designs to be co-owned! though, i am not responisble for any grievances between you and the co-owners. do not bring me into such a situation, it is not my fight to settle. this also applies to tbd's (trade back deals) involving my designs. if i am not directly involved, then do not bring me into it.

⤷ ✧ in addition with co-owns, it is required that the oldest th stays up no matter what. you may make addtional ths (Which i must be credited on as well) to share with co-owners, but the original must stay up no matter what. (you may delete additional ths, but NEVER the original/oldest.

⤷ ✧ If you are scammed by someone pretending to be me with my art/designs/charcs, i am not at fault for it. I will not be issuing your refunds as this is not something i was involved in. though, please do inform me if you see an impersonator so i may deal with it.

⤷ ✧ intentional chargebacks will result in an immediate blacklist. i may not have the funds to issue this chargeback and it can cause major issues with my management. you may just directly talk to me if needing to cancel/refund.

greylisted may own my designs, but they may not commission me (even if by another user as gift art) or directly interact with me in anyway (this includes buying designs directly off of me). At this moment, I will be highly against interaction even if making amendsblacklist may not own my designs or commission me. IF you want to commission a piece for them, you will end up on this list as well. I do not want to draw, own, or generally interact with their designs and as a person. (redesigned versions of blacklisted users may be different, please discuss with me on how i may feel about this situation)this may change and be updated. you as a buyer/owner of my designs and art must stay updated to this to prevent selling/trading of my designs and art to grey/blacklisted users. doing so will end up with you on this list as well.
